FAQ

Questions people ask us

Plain answers about registering property in Kerala. If yours isn't here, ask us on WhatsApp. We typically reply within 4 hours.

Process

How long does registration take?

If all the documents are in order, usually two to four weeks. Most of that time goes into getting certificates from government offices. After the free check, we give you a realistic timeline for your property, not a hopeful one.

Do I need to come to the office?

Not until registration day. Most of the work happens over WhatsApp. On the day, the buyer, the seller and two witnesses come to the Sub-Registrar Office with original ID, where fingerprints and photos are taken. Our coordinator is there with you.

Which Sub-Registrar Office will we use?

Usually the office that covers the property's area. We book the slot and tell you the time and the place well ahead.

Can you work with my bank if I have a home loan?

Yes. We prepare the documents your bank needs and time the registration to suit the loan disbursal, so neither side is left waiting.

What happens after registration?

We get the land tax (thandaper) moved into your name, which is called mutation. Then the building tax and the electricity connection. Finally we hand you the registered deed and your complete file.

Costs

Why is my stamp duty higher than 10% of the sale price?

Stamp duty and the registration fee are charged on the higher of your sale price and the government's fair value for that survey number. If the fair value is higher, you pay on the fair value.

What if stamp duty is underpaid?

An undervalued deed can be referred for recovery, and penalties may follow, sometimes years later. That's why we check the fair value before we calculate anything.

Do I need to deduct TDS?

If the property value is ₹50 lakh or more, the buyer usually deducts 1% TDS from the payment to the seller and files it with the Income Tax Department. The rate is higher if the seller is an NRI. We'll flag it in good time, and your CA files it.

How and when do I pay?

For our fee: an advance to start, and the balance on registration. Government charges go into our separate client account just before registration. Every payment is receipted.

Documents and problems

What is an Encumbrance Certificate (EC)?

It lists every registered deal and loan on the land over a period. We check 30 years, not the minimum, so a hidden loan or an old claim doesn't surprise you later.

The seller's original deed is with a bank. Is that a problem?

No, it's common. The loan is closed or taken over at registration, and the bank releases the deed. We handle the paperwork between everyone.

What if the land is in the paddy or wetland data bank?

You can't build on it without conversion, which takes time and isn't always approved. We check this before you pay an advance, not after.

The survey number on the deed doesn't match the village records.

This happens often after re-survey. We find the mismatch early and get it corrected or documented before registration.

NRI and family

I live abroad. Can I buy or sell without coming to Kerala?

Yes, through a power of attorney given to someone here. It must be attested correctly abroad and stamped in Kerala within the time allowed. We guide you through each step, so it is accepted the first time.

Can I transfer property to my children or spouse?

Yes, through a gift or settlement deed. Family transfers are charged at lower rates than a sale. We'll tell you which deed fits your family.

We inherited land. What do we need to sell it?

Legal heirship papers, and the consent and signature of every heir. We list exactly what your family needs, one item at a time.
